TOGNAZZI INSIGHTS | Italian Property Law: Case Law, Information and Professional Networks Why case law matters when dealing with property in Italy In July and August 2026, the Italian Court of Cassation and the administrative courts issued a number of decisions concerning condominium property, ownership, adverse possession, building distances, leases and public housing. These are technical legal matters, but they can become directly relevant to a property transaction. Questions concerning common parts, the use of a property's subsoil, building distances, possession or lease arrangements can become relevant when a property is purchased, sold, leased or managed. For this reason, Agenzia Immobiliare Tognazzi also follows developments in legislation and case law affecting the property sector. Access to current information, data, analysis and professional relationships forms part of the broader framework within which the agency supports its clients. Recent Italian property case law The following is a summary of some of the principal decisions referenced by Confedilizia in issue no. 15 of Giurisprudenza sugli immobili, published on 4 September 2026. CONDOMINIUM Septic tanks and common parts The Court of Cassation held that a septic tank located beneath a building and receiving wastewater from the apartments falls within the condominium's common parts under the presumption established by Article 1117 of the Italian Civil Code, unless the title provides otherwise. Court of Cassation, Order No. 23936 of 23 July 2026. A condominium owner's use of the subsoil The same decision also addressed the use of the subsoil by an individual condominium owner. Works intended to improve the enjoyment of an exclusively owned property are permitted where they do not compromise the intended use of the common property, the stability of the building or the equal rights of the other condominium owners. An individual owner may not, however, use the common subsoil to extend their premises or create additional rooms without the consent of the other condominium owners. Court of Cassation, Order No. 23936 of 23 July 2026. OWNERSHIP Boundary walls and building distances The Veneto Regional Administrative Court (TAR Veneto) clarified that the exclusion provided by Article 878 of the Italian Civil Code for boundary walls no more than three metres high does not apply where the wall also permanently serves to retain an artificially created embankment. In such circumstances, the structure may therefore be treated as a “construction” for legal purposes and must be taken into account when determining the applicable building distances. TAR Veneto, Venice, Section II, Judgment No. 1714 of 20 August 2026. Adverse possession and possession Awareness that a property belongs to someone else does not, in itself, automatically exclude the possibility of acquiring ownership through adverse possession (usucapione). The circumstances must be assessed in the individual case, including the conduct of the possessor and whether it demonstrates an unequivocal intention to exercise an independent proprietary right over the property. Court of Cassation, Order No. 23931 of 23 July 2026. LEASES The activity carried out in leased premises In relation to commercial leases, the Court of Cassation reaffirmed the importance of establishing the actual nature of the activity carried out in the leased premises, including for the purpose of determining whether specific statutory protections under Italian lease legislation apply. The classification of the activity and the interpretation of communications exchanged between the parties may therefore also be relevant to the statutory right of redemption under Italian law and to withdrawal on serious grounds. Court of Cassation, Order No. 23762 of 22 July 2026. PUBLIC HOUSING Taking over an existing public-housing allocation The Campania Regional Administrative Court distinguished between the public-law stage governing the allocation of public housing and the subsequent management of the tenancy relationship. It held that disputes concerning taking over an existing allocation during this second stage fall within the sphere of subjective rights arising from the tenancy relationship. TAR Campania, Naples, Section III, Judgment No. 4327 of 10 July 2026. From property information to client support These cases are only a few examples of the legal and technical issues that can arise around property in Italy. For an agency, understanding the market therefore involves more than prices, properties and transactions. It also means maintaining access to up-to-date information, specialist expertise, qualified professionals and established professional relationships when a particular situation requires a deeper level of analysis. This is also where professional networks can become relevant to the service provided to a client. The collaboration between L'immobiliare.com and Confedilizia, for example, enables agencies within the network to cooperate directly with Confedilizia's local offices, with the aim of strengthening client support, protection and dedicated services. For Agenzia Immobiliare Tognazzi, this is one of the resources available through membership of a wider organisation. It does not replace Tognazzi's own expertise and organisation. It complements them with a broader network of professional relationships, services and external specialist expertise. Tognazzi has its own organisation, tools, data, training and professional relationships, developed over time. At the same time, being part of a structured network creates additional opportunities for collaboration and access to qualified services when a client's situation requires them. For the client, the value lies not in the network itself, but in the additional information, professional relationships and services it can make available when a situation requires them. This is the reason for following developments in property law and maintaining professional relationships beyond the agency itself: not to add complexity to the transaction, but to have the relevant information, contacts and resources available when they are needed. The objective is to build an organisation capable of providing an increasingly complete and structured service to those who entrust Agenzia Immobiliare Tognazzi with a property decision.
